
A woman in Oregon says that she was impregnated with the wrong sperm during fertility treatments 44 years ago.
The woman, identified only as C.W., is suing Oregon Health and Science University and Providence Health, WANE-15 reported. The lawsuit seeks about $17 million in damages, alleging negligence, negligent inflictions of emotional distress, sexual battery, fraud/fraudulent concealment, and breach of contract.
According to the station, the lawsuit states that C.W. and her husband, K.W., sought fertility treatments in 1980. K.W.'s sperm was tested as part of the process.
Around the same time, another man, identified as R.W. also was visiting the health care facility and also had his sperm tested, the station reported.
In 1981, C.W. had an insemination procedure with the intention of using her husband, K.W.'s sperm. "Unknown to C.W., K.W. and R.W., however, defendants wrongfully used R.W's semen during the procedure," the lawsuit states according to the station.
According to Local-12, C.W. had a daughter who ended up with medical issues inherited from the stranger whose sperm was used.
Local-12 reported that genetic testing later confirmed that K.W. was not the father, yet when confronted with the evidence the lawsuit alleges that OSHU refused to admit the error.
"OHSU continue to conceal or otherwise deny that they wrongfully inseminated C.W. with a foreign donor's semen," the lawsuit states according to Local-12. "Further, OHSU has failed to properly investigate and notify its patients of medical errors after being placed on notice of Plaintiff's claims."
