Trump Returns to Court over Defamation Controversy Following Rape Accusations by Writer E. Jean Carroll

This week, a Manhattan jury deliberates on the financial price former US President Donald Trump should pay for defamation following accusations by writer E. Jean Carroll. Known for influential articles in Elle magazine, Carroll claimed Trump raped her years ago. The lawsuit marks their second legal standoff.

In a previous case, the jury ruled in Carroll's favor. They found Trump guilty of sexually assaulting and defaming Carroll, which led to her awarded damages of $5m (£3.9m) last year.

Trump's Statements Under Scrutiny

The trial underway puts the spotlight on Trump's statements from June 2019. The controversy stirred when Trump directly called Carroll's rape accusation a fabrication to boost her memoir sales. He further claimed not to have any prior knowledge of Carroll.

Trump's liability for sexually abusing Carroll got a jury's validation in May. However, no conclusion was reached on Carroll's alleged 90s incident of rape in a Bergdorf Goodman dressing room by Trump.

More Than Defamation, It's About Damage

In the aftermath of Trial One, Judge Lewis Kaplan, steering this defamation trial, dismissed the need for Carroll to evidence Trump's defamatory actions again.

The sole interest of this trial is in determining owed damages for Carroll. She seeks $10m in compensation, arguing reputational damages.

In an unusual move, Trump signaled a willingness to testify, but Kaplan issued a firm caution. Trump is restricted from claiming innocence in the sexual assault or accusing Carroll of faking her account.

Testifying or Chaos Theory?

Carroll's attorney, Roberta Kaplan (unrelated to the presiding judge), speculated Trump's testimony could turn the trial into a spectacle and derail the proceedings. She insisted Trump confirm under oath his comprehension of testimony limits.

In response, Trump's counsel, Alina Habba, confirmed Trump's understanding of the court's ruling and testimony restrictions.
