Recently, a federal appeals court decided not to revisit a case involving access to private communications from Donald Trump's Twitter account. This move has sparked a wave of controversy and debate around executive privilege.

Conservative judges at the court took this opportunity to share their disappointment in what they view as an unjustified erosion of executive privilege. These judges expressed disapproval towards their liberal colleagues and the initial judge in this case.

"Judicial disregard of executive privilege undermines the Presidency, not just the former President being investigated in this case," is how these judges voiced their outrage, underlining the potential repercussions of this decision.

How Does Executive Privilege Play a Role?

All four conservative judges in the D.C. Circuit Court of Appeals believe in the president's right to confidential communications and advice; however, they concluded that the dispute over special counsel Jack Smith's access to Trump's private Twitter messages was a moot point.

Despite their final agreement with their seven Democratic-appointed colleagues on the court, these judges elaborated extensively on the importance of executive privilege. The topic was not even raised for a vote for a rehearing of the case by the full bench.

Where Does the Concern Over Trump's Communications Reside?

As part of an investigation into Trump's actions during the 2020 election, prosecutors acquired much of Trump's Twitter data after secret court proceedings. The predicate for their apprehension lies in the decision of a district judge who ordered the company, now known as X, to release the data without notifying Trump. A three-judge panel from the D.C. Circuit later upheld this decision.

The Republican-appointed judges expressed their concerns that this would pave the way for other federal and state prosecutors to access a sitting president's privileged materials without prior notification by simply accessing materials through a third-party company like social media platforms or phone services.

Is the Debate Over Trump's Twitter Messages Over?

X, the company involved in this controversy, may consider appealing the ruling to the U.S. Supreme Court. However, the impact of such an appeal might be limited since Smith has already obtained Trump's data due to a court order issued by U.S. District Judge Beryl Howell last year.

Judge Rao points out that the protocol employed by the prosecutor, including issuing a warrant to the social media company and a gag order preventing them from informing Trump about the request, seemed like an "end-run around executive privilege."
