Georgia Court Rejects Oldest Death Row Inmate's Appeal, Executes Him For 1979 murder

Geogia is all set to execute the oldest death row inmate in their maximum security. 72-year-old Brandon Aster Jones who was convicted of murder in 1979 is scheduled to face his death by lethal injection 7pm on Tuesday.

Jones' lawyers previously asked the justices to block the planned execution as he is challenging the State's lethal injection secrecy law and he believes that death sentence is disproportionate to his crime.

However, the Atlanta federal court voted for the rejection of Jones appeal. According to NBC News, the court voted 6-5 not to hear the convict's appeal. A three-panel judge also voted in favor of the execution. The federal court said that the lawyers of Jones failed to show enough grounds to revoke the decision of the court.

"Today Brandon Jones will be executed, possibly in violation of the Constitution. He may also be cruelly and unusually punished in the process", the four judges said.

According to Yahoo News, Jones refused to request a last meal. Instead, he the standard prison menu of chicken and rice, rutabagas, seasoned turnip greens, dry white beans, cornbread, bread pudding and fruit punch will be served to him before the execution.

Jackson was convicted together with Van Roosevelt Solomon for murdering a convenience store manager Roger Tackett in a 1979 robbery in Atlanta's suburbs. As noted by ABC News, Solomon, who faced similar sentence was executed in Georgia's electric chair in February 1985. 

Jones, who has appealed for his case for decades now, is set to be injected with barbiturate pentobarbital at 7 p.m. at the state prison in Jackson Prison State. His execution is slated to take place about two weeks before state officials plan to carry out another death sentence on convicted murderer Travis Clinton Hittson. Hittson's execution is set for Feb. 17.
