If you have any type of US Visa allowing you to visit the country, it is extremely important that you are fully aware of the expiration date of the visa and the limitations that you have in regards to your stay in the country, among other things. There are a lot of different times when someone may be able to visit the US without a visa at all, but it is equally important in that instance that you understand the limitations of your stay, as well. If you are planning to work or study in the United States, then you will need a Visa issued by the US Department of State that will go in your passport. 

Getting a US Visa can be a great opportunity for you and will help you facilitate a variety of different things while you are visiting the country depending on the type of visa and the nature of your visit. If you were to overstay your temporary visa, however, you will quickly find that there are many consequences to this overstay that will cause you a variety of discomforts.

If you find yourself in a situation where your visa has expired, you will benefit from immigration lawyer advice. Take a look below at some of the consequences that you can expect or may encounter if you are caught overstaying your own visa in the US.

Bans On Re-Entry

Depending on how long you overstayed your visa, you may run into issues with being banned from entering the country again or other, lesser issues when filing for another visa in the future. If you overstay your visa by under 180 days, then you may have your next visa application denied (although if you work with an attorney or make appropriate attempts to resolve the issues around your overstay, you may be able to avoid this issue altogether). 

However, if you are found to have overstayed your visa for more than half a year, you may have a 3-year ban on returning (under 1 year overstayed), or a 10-year ban (overstayed by more than a year). In some cases, your overstay may be combined with a deportation order, which could result in a lifetime ban on re-entry to the United States. Again, a reason for hiring an attorney.

Denied Extension Request

If you are found to have overstayed your visa then you will likely have issues applying for an extension that may have been a simple process if undertaken before your visa expired. It is much easier to request an extension while you are still within your allowed stay than to ask for an extension once you have overstayed.

Your Visa Will be Voided

If you are under a current visa but run into some sort of overstay issue, then your visa will automatically be voided and revoked, which will have serious implications for a variety of your needs and issues. If you want to ensure that all of your needs with your visa are met, then make sure that you pay close attention to all of the restrictions that you must adhere to, including the amount of time that you are allowed to remain in the country during any given length of time.
