Matia Divac, son on of former NBA player and now Sacramento Kings Vice President Vlade Divac, was arrested on Thursday morning and charged with driving under the influence.

Fox40 reports that a California Highway Patrol officer stopped the 21 year-old Divac's 2015 Tesla on Capitol Avenue near west of 21st Street for a traffic violation.  The officer determined that Divac was intoxicated and was arrested.

He was booked into the Sacramento County Jail without incident, CBS Sacramento confirms.  The authorities, however, declined to comment regarding his blood alcohol level at the time of his arrest.

The State of California, according to DMV.org, enacted a law called "Admin Per Se" which enables law enforcement to confiscate a suspected offender's driver's license.  The license is sent to the DMV and can only be returned after serving out the suspension or the charge is dismissed at a hearing.  The arresting officer will then issue to the driver an Order of Suspension and possibly a temporary license.

The State of California considers the following levels of blood alcohol concenrtration (BAC) to be driving under the influence (DUI): 0.08% or higher for 21 years old above and operating a regular passenger vehicle, 0.04% or higher when operating a commercial vehicle and 0.01$ or higher when the driver is below 21 years of age.

If Matia Divac is found guilty and on top of the immediate license suspsension via Admin Per Se, he could face fines of up to US$ 1,000, enrolment in a DUI program, installation of an ignition interlock device and possible 6 months of jail time. 

If this is the second time he has been charged with DUI and subsequently convicted, he could face longer license suspension and jail time on top of paying stiffer fines.

If this is his third offense, he could receive life sentence with possibility of parole only after 25 years.

DUI convictions stay on the driver's record for 10 years.
