Francis Wagner, who resides in New Jersey, officially filed a lawsuit against his ex-wife for damages for physical and emotional distress brought by written insults on the weekly alimony checks he received from his ex-wife. The said spousal support checks always come with derogatory remarks which caused him agony.

According to NJ.com, Francis Wagner, 61, pushed through with his complaint before the Morris County Superior Court on Thursday, December 12, 2015. According to the filed lawsuit, he complained about the regular missive calling done by his ex-wife on the $186 checks issued to him on a weekly basis. His ex-wife refers to him as 'bum' and 'loser' among other distressful words. The said check was posted on Facebook by the Denville-based law firm, Trautmann & Trautmann, in March - and it does show that it was addressed to Francis Wagner from his ex-wife Diane Wagner for Alimony/Adult Child Support.

Diane Wagner, on the other hand, is said to be undergoing cancer treatment and exclaimed that she is sending her ex-husband an amount of $744 a month and thus also remarked that she can write anything she wishes on the check as a note to herself, Philly.com reports. In addition, Diane Wagner also claimed that she pays his ex-husband, Francis Wagner, religiously each month. In this turmoil between exes, the said lawsuit is seeking an unspecified amount for the emotional distress as a cause professed by the complainant.

In accordance with the details of the paycheck posted on Facebook by Trautmann & Trautmann, they have emphasized on the note that they are going to push through in stopping harassment against their client, Francis Wagner. And by the said posting, Diane Wagner proceeded to writing those ill remarks on the check about her ex-husband because she felt humiliated seeing the paycheck online when she can barely afford issuing some due to her cancer treatment, CBS 58 reports.

Francis Wagner is still bent on pursuing his case against his ex-wife. A counter sue is not yet reported to be happening from Diane Wagner's side. Moreover, legal actions and other legal briefs as per the complaint will be further reviewed by the Morris County Superior Court.
