18 year-old seeks court order to force her parents to pay for school

According to the New York Daily News, a 18 year-old New Jersey student has filed a case in court against her own parents after allegedly been tossed out of their home in Lincoln Park, New Jersey. Rachel Canning is looking for her parents, Sean and Elizabeth, to cover her private high school and college tuition fees as well as legal costs to file the lawsuit.

Canning said in her lawsuit that she was ejected out of her home shortly after turning 18 on November 1 last year as her parents had promised to cut financial and emotional support. Daily News said that the teenager is currently residing at a classmate's house in Rockaway, and that her classmate's father, John Inglesino, currently takes care of Canning's legal bills.

Court papers obtained by The Daily Record partly read, "My parents have rationalized their actions by blaming me for not following their rules. They stopped paying my high school tuition to punish the school and me and have redirected my college fund, indicating their refusal to afford me an education as a punishment."

The lawsuit was filed last week and Canning is expected to appear with her lawyer Tanya Helfand Tuesday in Morristown Family Court. Canning is demanding her parents to pay an outstanding tuition bill at Morris Catholic worth $5,306 and pay the $12,597 on accrued legal expenses. Daily News also said that Canning is demanding that her parents shoulder her college tuition fees, as she has been accepted to several schools.

The NY online news report said that Canning's lawsuit mentioned a domestic abuse incident, wherein she claimed that a teacher had witnessed a rough conversation between her and her mother last October, which ended badly.

The Daily Record said Canning's father is furious about the feud has reached the courts, and insisted that his daughter was found to be spoiled and petulant by a Division of Child Protection and Permanency representative who visited their home.

Daily News said Canning's claim could be warranted based on an earlier New Jersey court decision which ruled that young adults could rely on their parents for financial support even if they are of legal age to be declared as an independent adult.
